Terms and Conditions of the Ostras Promotion
Earn rewards for rescuing products close to their expiration date from supermarkets.

You are participating in a pilot program. Your contributions help us test and improve the system before we roll it out more broadly
During this pilot phase, rewards will be distributed once we achieve sufficient participation to validate the App’s effectiveness. The anticipated compensation—such as gift cards, discounts, or insights—will be provided after the pilot reaches key milestones. We greatly appreciate your support in this early phase; your involvement is crucial in building something impactful!

PROVIDER AND PURPOSE OF THE APP
1.1. The company Ostras OÜ (hereinafter, “Ostras,” “we,” “us,” and “our”), with its registered office at Harju maakond, Tallinn, Kesklinna linnaosa, Ahtri tn 12, 15551, Estonia, and holding registration number 17077314, provides the application Ostras Descuentos (“App”) for users to:
1.1.1. earn points by uploading a payment receipt to the App proving that you purchased food products with an expiration date of 5 days or less at the time of purchase (“Product”) in physical supermarkets located in Spain; these points will be accumulated and can be redeemed for rewards [ – we are currently not offering rewards as this is a trial, and rewards will only be available once we reach [x] users.]; and
1.1.2. discover “promotions” of near-expiration food Products available in grocery stores.
1.2. We provide free access to the App, meaning there are no charges for using it. However, we leverage the data we collect through the App—including details about the Products you purchase, the stores where you make these purchases, and your location—to generate analytics. Companies such as food sellers, grocery stores, and other enterprises pay us for this information, which they use to optimize Product distribution, improve their food supply chains, prevent recurring food waste or design campaigns within our App. For more information, please refer to our Privacy Notice. 1.3.Your use of the App implies full and unconditional acceptance of these legal terms and conditions (“Terms”).
- TERRITORIAL SCOPE AND ELIGIBLE USERS
2.1 You may only use the App if you:
2.1.1 reside in the national territory of Spain, including the Peninsula, Balearic Islands, and Canary Islands (Ceuta and Melilla are excluded);
2.1.2 are over the age of 18 years;
2.1.3. bought the Products in physical supermarkets located in Spain (Ceuta and Melilla are excluded);
2.1.4. are an end-consumer, this means you use the App and purchase the Products for your personal use, rather than for resale or production purposes; and
2.1.5. create an account for using the App.

3.1 Participants will accumulate points for each rescued Product based on the following scheme:

3.2. The points allow you to earn the rewards available in the “Premio” section of the App.
4. STEPS TO PARTICIPATE
4.1. Purchase up to 3 units of Products per receipt in a physical supermarket in Spain.
4.2. Keep the purchase receipt as proof.
4.3. Scan the QR code on the Ostras homepage or click on one of the following links (English / Spanish) to activate the flow.
4.4. Complete upload valid purchase receipts (legible, uncut, showing the retailer’s name, the Products, the amounts paid, and the date), as well as photos of the Product rescued with visible expiration dates and barcode.
5. ACCEPTABLE USE
5.1. Use of the Ostras App is designed to encourage:
5.1.1. rescuing Products nearing their expiration date from participating stores;
5.1.2. accumulating points from verified purchases for personal rewards;
5.1.3. discovering and engaging with offers on near-expiration goods in a responsible and respectful manner; and
5.1.4. using the App’s features to enhance personal consumption practices without intrusive or disruptive behavior.
5.2. By using the Ostras App, you agree not to:
5.2.1. engage in any unlawful activities or violate these Terms;
5.2.2. restrict or inhibit other users from accessing or enjoying the App;
5.2.3. misuse system resources or disrupt the normal operation of the App;
5.2.4. share or transfer your account access to third parties;
5.2.5. extract, misuse, or manipulate data for unauthorized purposes, such as spamming; and
5.2.6. use information from the App for business purposes without explicit consent.
5.3. Participation through fraudulent means is strictly prohibited. Users found engaging in deceptive practices will face immediate termination of access and possible legal action.
6. STATUTORY WARRANTY AND LIMITATION OF LIABILITY
6.1. You are entitled to a statutory warranty of three (3) years under Spanish law, ensuring that the App functions as agreed and is free from defects.
6.2. The warranty does not cover defects resulting from your misuse or unauthorized modifications to the App, or events beyond Ostras’s reasonable control relating to the App.
6.3. Ostras does not sell any Products and provides no warranties or guarantees regarding any third-party Products that may be accessed or displayed through the App.
6.4. The App is not sponsored, endorsed, administered by, or associated in any way with Instagram, Facebook, TikTok, or LinkedIn.
6.5. Any promotions advertised on the App are subject to Product availability and logistical limitations.
6.6. Ostras’s liability is limited to direct damages and excludes indirect or consequential damages, except as required by law. Nothing in these Terms excludes or limits Ostras’s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable mandatory law.
7. MODIFICATIONS TO THE APP
7.1. Ostras reserves the right to modify the App or any part thereof—including its features, functionalities, and content—at any time and without prior notice, where such changes are reasonably necessary to improve the App, ensure compliance with applicable laws and regulations, address technical or security requirements, or for other legitimate operational reasons. Examples of legitimate operational reasons include redesigning the App’s layout to simplify navigation, adding new features to enhance functionality, updating content to include references to current promotions, and scaling server capacity to handle increased traffic.
7.2. We will inform you of any changes via the App or by other appropriate means within a reasonable period, before the changes take effect. Your continued use of the App following any modification constitutes your acceptance of the modifications. If you do not agree with the changes, you must stop using the App and may terminate your agreement without penalty.
8. MODIFICATIONS TO THE TERMS
8.1. Ostras reserves the right to modify these Terms at any time to reflect changes in applicable laws, regulations, or the operation and modifications to the App.
8.2. We will inform you of any changes via the App or by other appropriate means within a reasonable period, before the changes take effect. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must stop using the App and may terminate your agreement without penalty.
9. TERMINATION
9.1. These Terms are for an indeterminate duration. Ostras and you may terminate these Terms as follows:
9.1.1 As a rule, Ostras will give you at least one (1) month’s notice before any termination, including if it decides to discontinue the App. However, we reserve the right to terminate these Terms without prior notice if we have reasonable suspicion or evidence that you have materially breached these Terms or engaged in any illegal behavior involving the App. Ostras reserves the right to exclude any participant who breaches these Terms or makes abusive or fraudulent use of the App. Once you are informed of our decision to terminate these Terms, you may appeal our decision by sending a substantiated request to info@ostrasdescuentos.com.
9.1.2. You may terminate these Terms by deleting your account.
10. APPLICABLE LAW AND COMPETENT JURISDICTION
10.1 These Terms are governed by the laws of Spain, excluding its conflict of laws rules, and any disputes arising from them shall be submitted to the competent courts of Spain.
